1. Who you are contracting with
These Terms of Use ("Terms") are an agreement between Outerfar Studios, a sole proprietorship of Christopher Prokop, Reutte, Tyrol, Austria ("we", "us"), and you as the end user ("you"). Contact: office@outerfar.com.
They apply to our software and services, in particular the game PHOTONKATANA, whether you use it in a web browser at photonkatana.outerfar.com or as an application obtained from the Meta Horizon Store.
2. Relationship to the store you bought from
If you obtained the application through the Meta Horizon Store, your purchase is a contract between you and Meta as the seller. Payment, invoicing, cancellation and refunds are handled under Meta's terms and refund policy — please address those requests to Meta, not to us.
These Terms govern your use of the software itself. Meta's own terms apply in addition; where the two conflict regarding the purchase, Meta's terms prevail for the purchase.
3. Licence
We grant you a non-exclusive, non-transferable, revocable licence to install and use the software for your personal, non-commercial purposes on devices you control. We retain all rights in the software, its source code, artwork, audio and branding.
Public play — streaming, video and screenshots, including monetised channels — is expressly permitted. Please credit "PHOTONKATANA by Outerfar Studios".
4. What you may not do
- Reverse engineer, decompile or modify the software, except where the law expressly permits it despite this clause.
- Resell, rent, sublicense or redistribute the software or parts of it.
- Manipulate scores, use automated input, or otherwise interfere with the leaderboard or our servers.
- Choose nicknames or submit feedback that is unlawful, insulting, hateful, or infringes third-party rights.
- Circumvent technical restrictions or attempt to gain unauthorised access to our systems.
5. Accounts, nicknames and leaderboard
The game is fully playable without an account. Signing in with Google is optional and only serves to place you on the global leaderboard. Your nickname and score are publicly visible. We may remove entries and nicknames that violate section 4, and we may reset a leaderboard season; this does not affect your right to keep playing.
What data we process and how you can export or delete it is described in our privacy policy.
6. In-game items and progress
Photon Shards, blades, trail styles and similar items are earned through play only. They cannot be bought, sold or exchanged for money, hold no monetary value, and are not your property — they are a feature of the software licensed to you under section 3. Progress is stored locally on your device; clearing your browser data or the app's storage deletes it.
7. Alpha and early versions
PHOTONKATANA is currently distributed as a technical alpha / early access build. Content, balancing, visuals and performance change frequently; features may be added, altered or removed, seasons may be reset, and interruptions may occur. Where a version is labelled as alpha, beta or early access, you should not expect final-release quality.
8. Health and safety in VR
Play standing or seated in a cleared area, keep the guardian/room boundary active, keep people, pets and objects out of arm's reach, and use the wrist straps. Take a break of at least 10–15 minutes every half hour. Stop immediately if you feel dizziness, nausea, eye strain or discomfort. Do not play while tired, under the influence of alcohol or drugs, or if you are pregnant, elderly, or have a heart condition, epilepsy or a history of seizures without consulting a doctor first. Follow the safety instructions of your headset manufacturer.
9. Availability
We are a one-person studio and offer the online components (leaderboard, sign-in, feedback) as they are available. We do not promise a specific uptime and may modify or discontinue online services, giving reasonable notice where feasible. The single-player game remains playable offline once cached.
10. Warranty and liability
Your statutory warranty rights as a consumer remain unaffected — nothing in these Terms limits them.
We are liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body or health, and under the Austrian Product Liability Act. For slight negligence we are liable only for breach of an essential contractual obligation, and then limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.
11. Term and termination
The licence runs for as long as you use the software. You may end it at any time by uninstalling and ceasing use. We may suspend or terminate the licence for a serious or repeated breach of section 4, after warning you where that is reasonable.
12. Changes to these Terms
We may amend these Terms where necessary for legal or technical reasons or to reflect changes to the software. We will publish the new version here with a new effective date. If a change materially disadvantages you, you may stop using the software; continued use after the effective date counts as acceptance.
13. Applicable law and disputes
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, you additionally keep the mandatory protections of the law of your country of residence, and you may bring proceedings at the courts of your place of residence.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Severability
If a provision of these Terms is or becomes invalid, the remainder stays in force.
